A friend of mine has 2 lawsuits going on with this developer. From the stories I can only gather that they are the worst scum of the earth.

Ed, I have heard that the developer you're talking about is very close to the government. I doubt if your friend will succeed in his lawsuit.
Your friend should have taken the lower floor. There is no way, he will win this, without spending a fortune.

Hi guys, new to this forum and joined specifically to find other people that have been the victims of Btesh & Virzi. We are having the same problem as your friend, Ed, and were moved as our floor was eliminated due to structural changes, and we are in the process of launching a lawsuit as well. I would appreciate being in contact with your friend to see if we can help one another.
As for your comments, Mordekha, no offence but if people would think like you, slavery would still exist, women would not have the right to vote, and Poland would still be communist! We are talking big bucks here, and in our case our retirement savings, and there is no way we are going to give up.

And how much have you lost exactly in the hands of these crooks? Nothing I guess. To be honest, I am stunned by advices such as yours and janl - not what I would call "support". Are you guys getting a pay checks from Btesh? Call me delusional or what you like, but I will not be follow cowardly advices. I will be standing for my rights regardless of these guys last name, their connections or who they can bribe.

You are getting good advice and you need to listen to that advice because you will never win a battle in Panama by filing a lawsuit. I would meet with the developers directly and try to reason with them to achieve a reasonable settlement. ANy settlement you can negoiate directly with the promoter will produce a better result than litigation in Panama. It would take four years for a case to be litigated in Panama. You better read your contract because I would guess it has a provision to move your apartment if there is a change of design. You can expect to spend about $50,000 or more in legal fees with no guarantee of a favorable result. If you litigate the dispute you will lose and never recover your deposit even in the 5% chance you prevail after four years of litigation. The legal system in Panama is not like the USA or any western country with a system of law.

It is not a cowardly advice. If you want to waste time, energy, and money then by all means go ahead. I was just telling you how much chance you stand in my opinion. Panama is not america or europe. Maybe after 1 or 2 years of throwing good money after bad you will see that advice you dont like can also be support. Sometimes it is smarter to cut your losses.

I'm embarrassed to say I have some personal experience with fraudulent developers. Throw a few thousand dollars at the problem if you want and maybe it will shake loose a better offer, but as far as litigation offering a solution, I'm afraid that it is extremely doubtful.
I wish there were more people like Jared Loughner, Ted Bundy and Jeffrey Dahmer buying real estate in Panama.
I wish people would be smart enough to only buy existing property in 3rd world countries that would save them so much headache.
