Judicial Audit Reveals Corruption in Panamanian Courts

By José Otero for La Prensa - Irregularities uncovered during audits performed on the millionaire bankruptcy cases of Fotokina and Adelag of several courts of the Panamanian judicial system "made me feel like crying," said the President of the Panamanian Supreme Court Harley Mitchell. The Chief of the Judicial System said the results of these judicial inspections caused the same effect as "peeling an onion," and accepted that he cannot hide his concern over the situation. He added that he received a preliminary report this week but did not provide any further details of what might be contained in the audits, and only said he will wait for the final conclusions from the Direction of Legal Audits of the Judiciary before taking corrective actions. Mitchell assured “there will be no contemplation” (leniency) with those employees who might have been responsible for the irregularities. But he admitted that this situation also can reduce (have negative effects) on the justice system, due to the negative effect on transparency that must reign (in the system.) Mitchell ordered audits of the Fotokina and Adelag cases in March 2008, and in June auditors also began similar inspections of five courts in the Second and Third Judicial Districts of Panama, into supposedly irregular acts committed within these offices.
Editor's Comment: Ah ha! A cleanup of corruption in the Judicial system. Well, it's about time. The Panamanian judicial system has been notoriously corrupt for a long time, and it's glad to see the impact and effect of having Harley Mitchell at the helm, as he continues to make strides in breaking the culture of corruption in the Judicial System. Baby steps, sure - but I choose to applaud the positive. Anything is better than nothing, and I wish they would go kick some ass up in Bocas del Toro next.

Culminan auditorías judiciales

Las irregularidades encontradas en las auditorías efectuadas a los casos por las quiebras millonarias de Fotokina y Adelag –y a varios juzgados judiciales– “dan ganas de llorar”, dijo el magistrado presidente de la Corte Suprema de Justicia, Harley Mitchell.


El jefe del Órgano Judicial sostuvo que los resultados de estas inspecciones judiciales causan el mismo efecto que “cuando se está pelando cebolla”, y aceptó que no puede ocultar su preocupación por esta situación.


Agregó que esta semana recibió un informe preliminar, pero evitó dar detalles del contenido de las auditorías y se limitó a decir que esperará las conclusiones finales de la Dirección de Auditoría Legal del Órgano Judicial, para tomar los correctivos.


Mitchell aseguró que “no habrá ninguna contemplación” con los funcionarios que pudieron haber incurrido en irregularidades. Pero admitió que esta situación también puede menoscabar el sistema de justicia, por las afectaciones en la transparencia que ahí debe imperar.


Las auditorías a los casos Fotokina y Adelag fueron ordenadas en marzo de este año, y en junio pasado también se iniciaron inspecciones similares a cinco juzgados del Segundo y Tercer Distrito Judicial de Panamá, por supuestos actos irregulares cometidos dentro de estos despachos.
